PRIVACY AND DATA PROTECTION POLICY

1. Purpose of the Regulations

When developing the privacy policy of the Delikates Accessories webshop, we took the EU Data Protection Regulation 679/2016 as a basis.

2. Definitions

Personal data: data that can be linked to a specific natural person (hereinafter referred to as the data subject), in particular the name, identification number of the data subject and one or more specific physical, physiological, mental, economic, cultural or social characteristics that can be used to draw conclusions about the data subject. Personal data retain this quality during data processing as long as the relationship with the data subject can be re-established;

Data set: the set of data managed in a register;

Data processing: any operation or set of operations performed on data, regardless of the procedure used, including in particular the collection, recording, recording, organization, storage, alteration, use, retrieval, transmission, disclosure, alignment or combination, blocking, erasure and destruction of personal data, as well as the prevention of further use of the data;

Data processing: the performance of technical tasks related to data processing operations, regardless of the method and means used to perform the operations and the place of application, provided that the technical task is performed on data;

Data destruction: complete physical destruction of the data medium containing the data;

Data transfer: making personal data available to a specific third party;

Disclosure: making personal data available to anyone;

Data processor: the natural or legal person, or an organization without legal personality, who processes personal data on behalf of the data controller;

Data erasure: making data unrecognizable in such a way that its recovery is not possible;

Automated data set: a set of data that is automatically processed;

Machine processing: includes the following operations, when they are carried out partly or wholly by automated means: storage of data, logical or arithmetical operations on data, alteration, erasure, retrieval and dissemination of data.

3. Scope of personal data processed

To use the service, the User's email address, telephone number, name, place of residence/stay, the product category purchased by the User when ordering, the method of receipt and payment used by the User, and the item amount of the User's purchases are essential.

In order to provide customized service, the Service Provider places a small data package (so-called "cookie") on the User's computer. The purpose of the cookie is to ensure the highest possible quality of operation of the given site in order to increase the user experience. The User can delete the cookie from his/her own computer or set his/her browser to prohibit the use of cookies. By prohibiting the use of cookies, the User acknowledges that the operation of the given site is not complete without cookies.

4. Legal basis, purpose and method of Data Processing

The purpose of Data Management is to provide services available under the website address delikatesaccessories.com.

The purpose of the automatically recorded data is to provide services available through the Service Provider's websites, display personalized content and advertisements, prepare statistics, and technically develop the IT system.

The Service Provider may not use the provided Personal Data for purposes other than those specified in these points. The provision of Personal Data to third parties or authorities – unless otherwise required by law – is only possible with the prior, express consent of the User.

The Service Provider does not verify the Personal Data provided to it. The person providing it is solely responsible for the accuracy of the data provided. When providing an e-mail address, any User also assumes responsibility for the fact that he or she is the only one using the service from the provided e-mail address. In view of this assumption of responsibility, any liability related to logins made using a given e-mail address lies solely with the user who registered the e-mail address.

5. Data protection policies applied by the Service Provider

The Service Provider uses Personal Data that is essential for using the services of delikatesaccessories.com based on the consent of the data subjects and exclusively for the purpose for which it was collected.

The Data Controller undertakes to process the Personal Data it has received in accordance with the established data protection principles and not to transfer them to third parties. The exception to the provision contained in this point regarding data transfer is the use of data in a statistically aggregated form, which may not contain the name of the user concerned or other data capable of being identified in any form.

In certain cases – due to an official court or police request, legal proceedings, copyright, property or other infringement or reasonable suspicion thereof, harm to the interests of the Service Provider, endangerment of the provision of its services, etc. – the Service Provider makes the relevant User's available data accessible to third parties.

In all cases where the Service Provider intends to use the provided Personal Data for a purpose other than the purpose of the original data collection, it will inform the User of this and obtain their prior, express consent, or provide them with the opportunity to prohibit the use.

6. Disposal of Personal Data

Changes to Personal Data or requests to delete Personal Data can be communicated by means of a written statement sent via the service's internal email system. Newsletters can be unsubscribed by changing the user interface settings on the site.

After a request to delete or modify personal data has been fulfilled, previous (deleted) data can no longer be restored.

7. Possibility of data transfer

The Service Provider is entitled and obliged to forward all Personal Data that it has at its disposal and that it has properly stored to the competent authorities, which it is obliged to forward by law or a legally binding official obligation. The data controller cannot be held liable for such data forwarding and the consequences arising therefrom.

Some of the Users' personal data are transferred for specific purposes, based on the User's consent, as follows: the Service Provider transfers the Users' personal data and order data to the courier service in order to deliver the ordered packages. The personal data transferred in this way is processed in accordance with the courier service's own data protection and data management regulations.

8. Users' rights regarding their Personal Data processed by the Data Controller

Users may request information from the Service Provider about the processing of their personal data at any time by sending an e-mail to accessories@delikates.ro. The Data Controller considers a request for information sent by e-mail to be authentic only if it is sent from the User’s registered e-mail address. The request for information may include the user’s data processed by the Data Controller, their source, the purpose, legal basis, duration of the Data Processing, the name and address of any data processors, the activities related to the Data Processing, and in the case of the transfer of Personal Data, who received or will receive the User’s data and for what purpose.

The Data Controller is obliged to respond to any question related to Data Management within 20 working days.

The User concerned and all those to whom the data was previously forwarded for the purpose of Data Management must be notified of the correction, blocking or deletion of the Personal Data processed. Notification may be omitted if this does not violate the legitimate interests of the data subject with regard to the purpose of Data Management.

The User may object to the Processing of his/her Personal Data at info@delikates.ro or accessories@delikates.ro.
